The order appealed from sustained the respondents' demurrers to the causes of action pleaded in the appellants' amended complaint
on the basis that the causes of action are barred by the statute of limitations and ordered that the amended complaint be
dismissed. This appeal involves the timeliness of commencing a legal malpractice action. The plaintiffs commenced this action against
defendant attorneys by service of summons and complaint on September 15, 1972. The complaint contains two causes of action.
The first cause of action alleges negligence on the part of the four defendants in failing to file a proper application for
a patent on the plaintiffs' invention within the one year period after the product was first placed in public use and sold.
The second cause of action alleges negligence on the part of the defendants, Allan B. Wheeler, S. Lawrence Wheeler and Joseph
P. House, Jr., d/b/a Wheeler, House & Wheeler in advising the plaintiffs that they would not give up or lose any rights
or interests they might possess in their invention.
