1 REPORTER'S NOTE: Previously filed as an unpublished
opinion, the Supreme Court granted a motion to publish by an
order dated May 7, 1993, pursuant to Rule 7.04 (1992 Kan. Ct. R.
Annot. 33). Jack D. Boegel appeals the jury's denial of his claim of
fraudulent concealment in the purchase of a farm containing 21
center-pivot irrigation systems. Boegel claims the Colorado
National Bank of Denver (Bank) wrongfully withheld information
concerning defects in the irrigation wells on the farm. Boegel
claims the trial court erroneously denied his motion for directed
verdict and also erroneously instructed the jury on the elements
of fraudulent concealment.
